Introduction and contact details

We consider it very important that these data are handled with care and that they are treated confidentially and protected. Taaly therefore processes your personal data in accordance with the requirements imposed by privacy laws and regulations. Among other things, this means that we:

  • clearly state which personal data we process and for which purposes. We do this by means of this Privacy Statement;
  • try to limit the collection of personal data to only the personal data that are necessary for the specified purposes;
  • request the explicit consent of the data subject for the processing of personal data in cases where consent is mandatory;
  • do not retain the personal data for longer than is necessary for the specific purpose for which we collected the personal data.

For this reason, we have taken various technical and organizational measures within Taaly to ensure that personal data are processed lawfully, transparently and fairly within our organization. We also ensure that your rights as a data subject are respected and that you can exercise them at Taaly.

In this privacy statement you will find general information about how we handle your personal data and which rights you have in the area of privacy.

Do you have questions about privacy? You can reach Taaly by email at privacy@taaly.nl.

Controller and Processor

In most cases, Taaly is the controller for the processing of your personal data as described in this privacy statement. However, when you use the Taaly App on the instructions of, or as a mandatory part of a program with, a municipality (for example within the framework of the Wet inburgering (Civic Integration Act)), that municipality acts as the Controller.

In that case, Taaly acts exclusively as a Processor on the instructions of the municipality. The processing of your data then takes place in accordance with the arrangements we have laid down with the municipality in a data processing agreement. To exercise your privacy rights in these specific situations, you can contact your contact person at the municipality directly, although Taaly will of course facilitate you in this where possible.

Definitions

All definitions used in this statement have the same meaning as the definitions in Article 4 GDPR.

Scope

This statement applies to any automated processing of personal data, and to the processing of personal data that form part of a filing system or that are intended to form part of a filing system, by or under the authority of Taaly.

Purposes and legal basis

In order to assist you properly, we process your personal data. This starts from the moment you enter into a conversation with us.

We process your personal data for the purpose of offering a platform that provides tailored language coaching and integration for, among others, refugees, expats, migrant workers or international students (hereinafter: Learners) in the Netherlands. By means of the Taaly application (hereinafter: App), Taaly connects Learners with volunteer or paid Dutch speakers (hereinafter: taalcoaches (Taalmaatjes)). Learners and taalcoaches (hereinafter jointly: Users) create an account in the App (hereinafter: Account) in which they can indicate, among other things, their language level and interests. By means of an algorithm, Learners and taalcoaches are matched with each other and can communicate via messages, audio and/or video calls, in order to improve the language skills of the Learners.

Lawful basis

Taaly bases the processing of your personal data on one of the following legal bases:

  1. consent of the data subject
  2. necessary for the performance of a contract;
  3. on the basis of a legal obligation to which Taaly is subject;
  4. necessary in order to protect the vital interests of the data subject;
  5. because it is necessary for the performance of a task carried out in the public interest;
  6. necessary for the purposes of the legitimate interest.

Application of these legal bases:

For regular users who download and use the App on their own initiative, we process the personal data on the basis of the necessity for the performance of the contract (Article 6(1)(b) GDPR).

Specific legal basis for municipal programs:

When the use of the Taaly App is part of a municipal program (such as the Wet inburgering (Civic Integration Act)), we do not base the processing of personal data on consent. In these cases, the data are processed because this is necessary for the performance of a task carried out in the public interest that rests with the municipality (Article 6(1)(e) GDPR). In that case, the municipality is the controller. Consent is requested exclusively for optional functionalities that are not necessary for the core program, such as receiving commercial newsletters.

Sharing with third parties

To deliver our services, we make use of services provided by third parties. In some cases, this means that they process personal data on our instructions.

With all parties with whom we work and with whom we have to share your data, we have made sound arrangements about protecting these data. We lay down these arrangements in an agreement.

We also do this with the suppliers of our applications. We conclude a data processing agreement with them and require that they ensure the same level of security and confidentiality of your data.

We only share your data if this is necessary for the purposes we have described above.

A detailed overview of the external parties with whom we share personal data can be found in Annex 1 (Data recipients) of this privacy statement.

Transfer of personal data outside the EEA

In principle, Taaly processes and stores your personal data within the European Economic Area (EEA) as much as possible. However, for the delivery of specific services, such as the processing of payments via certain payment providers (e.g. Stripe), it may occur that personal data are transferred to or processed in countries outside the EEA, such as the United States. In such cases, Taaly ensures that this transfer takes place exclusively in accordance with the strict requirements of the GDPR. We do this by working exclusively with parties that are certified under the applicable EU-US Data Privacy Framework, or by concluding standard contractual clauses approved by the European Commission (Standard Contractual Clauses - SCCs), supplemented with additional security measures where necessary.

Retention period

We do not retain your personal data for longer than is strictly necessary for the purposes for which the data were collected, and in accordance with the applicable statutory retention periods.

When the Taaly App is deployed as part of a municipal program (in which Taaly acts as processor), the retention periods laid down by the relevant municipality (the controller) apply, usually based on the Dutch Public Records Act (Archiefwet) and the municipal selection list. After the end of the program or at the request of the municipality, these data are transferred or destroyed.

For regular users, we apply the following specific retention periods:

  • Account data and inactivity: If you delete your account yourself (for example by deleting the App), your account data are erased immediately. If your account has been continuously inactive for one (1) year, your account is automatically deleted by us, including all personal data linked to it. Prior to this deletion, we will send you a warning message.
  • Chat messages: The chat messages between Learners and taalcoaches are stored encrypted by default. To safeguard your privacy, chat messages are automatically and permanently deleted from our servers six (6) months after they have been sent, or immediately once the account is deleted (whichever occurs first).
  • Video calls: Video calls between Learners and taalcoaches are not recorded or stored at any time.
  • Financial and tax data: For paid taalcoaches (self-employed persons and private individuals), we are legally required to retain data related to payments, invoicing and payouts (such as bank account numbers, VAT numbers and business details) for the statutory tax retention period of seven (7) years for the Dutch Tax Administration (Belastingdienst).

After the expiry of the above-mentioned periods, or after a justified request for erasure, the personal data are securely destroyed or irreversibly anonymized, so that they can no longer be traced back to you.

Your rights

The GDPR provides you with various rights to maintain control over your personal data. Here we inform you how you can exercise this control.

Do you think your personal data are incorrect? Or would you rather not have your data retained? You can access your personal data and, if necessary, have them rectified or erased. You can:

  • Request access to the personal data we have recorded about you, so that you can check whether those data are correct and properly recorded in the system. You can also check whether we process your data in accordance with the law;
  • Ask us to change, rectify or complete the personal data if they are incomplete;
  • Ask us to restrict the processing, to erase data, or object to the recording of the data;
  • Request your digital data in a digital file. This is also referred to as “data portability”. This is only possible if the recording of the data took place on the basis of a contract or on the basis of your consent;
  • Object to the processing;
  • Request additional information. Do you still have questions after reading this privacy statement about how we handle your personal data? You can always ask us these questions at privacy@taaly.nl.

Handling of requests

After verifying your identity (to ensure that we are looking at the correct personal data), we will process your request. We check whether your request complies with the laws and regulations; if this is the case and we have all your details, we will handle your request within one month. We may have additional questions. Do you have a complex request? Then we may need more time to comply with your request, but we will inform you of this as soon as possible.

During access, we remove the personal data of other people. Consider, for example, the names of our employees. After all, just like you, they have a right to the protection of their privacy.

Refusing a request in full or in part

Sometimes we may refuse your request (in part). This may be the case, for example, in the following situations:

  • If the refusal is necessary in the interest of national security, public security, or the prevention, detection and prosecution of criminal offenses. Or to protect the rights and freedoms of others.
  • If, at the time of the request, an investigation into fraud or criminal offenses is ongoing to which the request relates.
  • If the request relates to ongoing legal proceedings. In ongoing objection or appeal proceedings, your request may be refused. After all, you will already receive the documents in that case.
  • If the request is so-called ‘excessive’. You may not submit an unlimited number of requests per calendar year relating to the same subject or case.
  • If we believe that there is an abuse of rights. You can access your personal data to check whether they have been recorded correctly. For example, you may not use that right to obtain more information when other proceedings are ongoing.

Would you like a copy of your personal data? In any case, you will receive an overview of all personal data that are processed about you. This does not mean that you will receive a copy of your file.

Questions or complaints about the data processing

Of course, we will be happy to assist you if you have complaints or questions about the processing of your personal data. For this, you can contact the Privacy Officer at privacy@taaly.nl.

Should you nevertheless be unable to resolve the matter, you have the right under the GDPR to lodge a complaint with the privacy supervisory authority, the Dutch Data Protection Authority (Autoriteit Persoonsgegevens, AP). For more information, see the website of the AP https://autoriteitpersoonsgegevens.nl/nl/zelf-doen/gebruik-uw-privacyrechten/klacht-melden-bij-de-ap .

Security of your data

Taaly takes both appropriate technical and organizational measures to protect your personal data against accidental or deliberate manipulation, loss, destruction, or access by unauthorized persons.

We require the same level of security from our partners and suppliers.

Taaly has drawn up a Privacy Policy and has taken the necessary security measures to protect your personal data. Examples include:

  • The secure exchange of personal data via the App or via email.
  • Determining who may have access to certain data on the basis of his or her position. Anyone who does not need this for his or her position is not granted access.
  • Employees are bound by a duty of confidentiality.
  • Organizing training for our employees, including on how to handle personal data securely.

Changes to this privacy statement

Taaly may amend this privacy statement from time to time, for example because we expand our services.

We recommend that you consult this privacy statement regularly, so that you are aware of these changes.

The most recent version of our privacy statement can be found here.
